Terms of Service
My California ADU (mycaliforniaadu.com) Effective date: October 16, 2026 Last updated: October 16, 2026
These Terms of Service ("Terms") are an agreement between you and Nicole Cappelletti, an individual ("we," "us," or "our"), who operates My California ADU (mycaliforniaadu.com) at https://mycaliforniaadu.com (the "Service").
By checking the agreement box, or by using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. What the Service is
The Service is a free, informational research tool. You enter a property address and an email address, and the Service produces a computer-generated summary (a "Report") about accessory dwelling units (ADUs and JADUs) for that address. A Report may include:
- a summary of publicly available ADU rules for the city or county that appears to cover the address;
- publicly available parcel information (for example, lot size, zoning label, or assessor data);
- rough, general cost ranges; and
- suggested next steps, such as who to contact to confirm the information.
The Service currently covers addresses in or near Riverside, Fontana, Temecula, Moreno Valley, Upland, and unincorporated Riverside County, California. Reports for other addresses may be unavailable or less accurate.
The Service is free. We do not charge fees or sell products, and we do not sell your information. The Service also offers two optional features, each of which you must separately choose by checking an unchecked box: (a) an email newsletter, and (b) a free-quote request, where we send your name, email, and property address to selected local ADU contractors (see Section 8A). If we ever start charging fees or receiving payment from contractors, we will update these Terms and the Privacy Policy first, and ask for your agreement where the law requires it.
2. What the Service is NOT
A Report is general information only. It is not:
- a zoning determination, permit, approval, entitlement, or official statement by any city, county, state agency, utility, or homeowners association (HOA);
- legal advice (we are not your lawyer, and using the Service does not create an attorney-client relationship);
- architectural, engineering, surveying, or design advice;
- contractor advice, a bid, an estimate, or a quote (we are not a licensed contractor, and cost ranges are not offers to do work);
- real estate, appraisal, tax, financing, insurance, or investment advice; or
- a promise or prediction that you can build an ADU, that a permit will be issued, or what a project will cost.
Only the government agency with authority over your property (your city's planning/building department, or the County of Riverside for unincorporated areas) can tell you what is actually allowed. Other rules may also apply, such as HOA rules, recorded easements or deed restrictions, utility and sewer/septic requirements, fire hazard zone rules, flood zones, and historic district rules.
3. You must verify everything
Before you make any decision or spend any money — including buying property, hiring a designer or contractor, applying for a loan, or starting construction — you agree to independently verify the information in a Report with the appropriate city or county department and with qualified licensed professionals.
You use Reports at your own risk.
4. AI-generated content notice
Reports are created automatically using artificial intelligence (AI) and automated data tools, with no human review of your specific Report. AI can:
- misread or misstate rules, codes, or data;
- mix up jurisdictions, parcels, or addresses;
- rely on sources that are outdated, incomplete, or since changed;
- state incorrect information in a confident tone; or
- produce information that sounds like it came from a source when it did not.
We try to link to the public source for each fact, but you should check the source yourself. If a Report and an official source disagree, the official source controls.
5. Data may be outdated or wrong
Reports rely on third-party public sources, such as city and county websites, municipal codes, GIS and assessor data, and state law. These sources may be incomplete, out of date, or wrong, and laws and local rules change often. We do not control these sources and do not guarantee they are current. A Report reflects information available to the Service at the time it was generated and will not be updated after it is sent to you.
Cost ranges are rough, general estimates based on public or general information. Actual costs depend on many factors (site conditions, design, materials, labor, fees, utilities, timing, and more) and may be much higher or lower.
6. Your responsibilities
You agree that you will:
- be at least 18 years old;
- enter only addresses you have a legitimate reason to research and an email address you are authorized to use;
- not use the Service for any unlawful purpose, or to harass anyone;
- not scrape, overload, reverse-engineer, or interfere with the Service, or use automated means to request Reports in bulk, without our written permission;
- not present a Report as an official, certified, or professional document, or as a statement by us or any government agency; and
- not submit information you know is false.
We may limit, suspend, or stop providing the Service to anyone, at any time, for any reason, including suspected misuse.
7. Intellectual property
The Service, its design, and its software belong to us or our licensors. Public-source data remains subject to its own owners' terms. We give you a personal, non-exclusive, revocable permission to view and keep your Reports for your own non-commercial use, including sharing them with your family, lender, designer, contractor, or a government agency in connection with your own property. You may not resell Reports or use the Service to build a competing product.
8. Third-party links and sources
Reports and the Service may link to third-party websites, including government sites. We are not responsible for their content, accuracy, availability, or privacy practices.
8A. Contractor quote requests (optional)
If you check the optional box asking for free quotes, we will send your name, email address, and property address to one or more local ADU contractors we have selected ("Contractors"). You understand and agree that:
- Contractors are independent businesses. They are not our employees, agents, partners, or representatives, and we do not supervise, direct, or control them or their work.
- No endorsement or recommendation. Being included is not an endorsement, recommendation, certification, or rating by us. "Selected" means only that a Contractor agreed to receive quote requests for your area; it does not mean we have vetted their quality, pricing, insurance, bonding, licensing, or reputation.
- No warranty of their work. We make no promises or warranties about any Contractor's quotes, services, workmanship, timelines, pricing, licensing, insurance, or conduct. Any agreement you make is solely between you and the Contractor.
- You do your own vetting. Before hiring anyone, you are responsible for checking their license status with the California Contractors State License Board (CSLB) at www.cslb.ca.gov, confirming their insurance and bonding, checking references and reviews, getting multiple written bids, and reading any contract carefully. In California, most home improvement work over $500 (labor and materials combined) requires a licensed contractor.
- Contractors' own policies apply. Once a Contractor receives your information, its use is also governed by that Contractor's own privacy policy and practices. We require Contractors to use your information only to respond to your quote request and not to sell it, but we cannot guarantee they comply.
- No obligation. You are not required to request quotes to use the Service, and requesting a quote does not obligate you to hire anyone.
- Withdrawing. You may withdraw this request at any time (see the Privacy Policy). We will stop sending your information to new Contractors, but we cannot recall information already sent.
- Disputes with Contractors. To the extent allowed by law, you release us from claims arising from a Contractor's acts, omissions, quotes, or work. (Attorney note: review whether this release, and any Civil Code section 1542 waiver, is appropriate.)
(Attorney note: this draft assumes we receive no payment from Contractors. Any per-lead fee, referral fee, subscription, or other compensation from Contractors must be reviewed by a California attorney before it starts — it may affect CCPA "sale" analysis, required disclosures, advertising/referral rules, and these Terms.)
8B. Newsletter (optional)
If you check the optional newsletter box, we will send you occasional emails about ADUs and the Service. Each email will include an unsubscribe link, and you can unsubscribe at any time without affecting your access to the Service.
9. No warranty
THE SERVICE AND ALL REPORTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, whether express, implied, or statutory, to the fullest extent allowed by law. This includes, without limitation, any warranties of accuracy, completeness, timeliness, reliability, merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any Report will be correct.
10. Limitation of liability
To the fullest extent allowed by law:
- We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost savings, lost property value, construction or design costs, permit or application fees, delays, or decisions you make based on a Report, even if we were told such damages were possible.
- Our total liability to you for all claims relating to the Service or any Report is limited to one hundred U.S. dollars (US $100). Because the Service is free, you understand this limit is a fair part of the bargain.
Some laws do not allow certain limitations of liability. Nothing in these Terms limits liability for fraud, willful injury, gross negligence, or any other liability that cannot be limited under California law (including California Civil Code section 1668). In those cases, the limits above apply only to the extent the law allows.
11. Indemnity
To the extent allowed by law, you agree to defend, indemnify, and hold harmless Nicole Cappelletti from any third-party claims, losses, and reasonable costs (including reasonable attorneys' fees) arising from (a) your misuse of the Service, (b) your violation of these Terms or the law, (c) your dealings with any Contractor, or (d) your use of, or reliance on, a Report in a way that these Terms do not allow, such as presenting it to others as an official or professional determination.
12. Governing law and where disputes are heard
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute relating to the Service or these Terms will be brought only in the state or federal courts located in Riverside County, California, and you and we consent to those courts' jurisdiction. Either party may bring an eligible claim in small claims court.
Before filing any claim, you agree to first contact us at hello@mycaliforniaadu.com and give us 30 days to try to resolve it informally.
(Attorney note: no arbitration clause or class-action waiver is included in this draft. Discuss with counsel whether one is appropriate.)
13. Changes to the Service and these Terms
We may change, pause, or discontinue the Service, in whole or in part, at any time.
We may update these Terms. When we do, we will post the new version with a new "Last updated" date. If a change is material, we will try to give notice on the site or by email before it takes effect. Changes apply only going forward. Your continued use of the Service after a change takes effect means you accept the updated Terms. We will not apply new fee, paid-feature, or data-sharing terms to you without your clear agreement.
14. General
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Service.
- Severability. If any part of these Terms is found unenforceable, the rest stays in effect, and the unenforceable part will be enforced to the greatest extent allowed.
- No waiver. Our not enforcing a provision is not a waiver of it.
- Assignment. You may not transfer these Terms. We may transfer them, for example to a business entity we form to operate the Service, with notice to you.
- Survival. Sections 2–5, 8A, and 9–14 survive after you stop using the Service.
